These terms are an agreement between you and Buddy Pools ("Buddy Pools", "we", "us"). They cover buddypools.com and the Buddy Pools app at app.buddypools.com (together, "the service"). By creating an account or using the service, you agree to them. If you don't agree, please don't use the service.
1. What Buddy Pools is
Buddy Pools is software for running pools among friends, family and co-workers. It keeps the picks, settles results, works out the standings, sends reminders and keeps a record of every change.
Buddy Pools is not a gambling or betting operator. We don't accept wagers, hold entry fees, pay out prizes or take a share of any pot. Any entry fees and prizes are arranged entirely between a pool's organizer and its players. Organizers and players are each responsible for making sure their pool is lawful where they live. If running or playing in a pool isn't lawful for you, don't use the service for it.
2. Your account
- You must be at least 18 years old, or the age of majority where you live if that is older.
- Give accurate information, keep your password private and use one account per person. You are responsible for what happens on your account.
- One account covers every pool you run or play in.
- Tell us atsupport@buddypools.comif you think someone else has used your account.
3. Organizers
The organizer of a pool chooses its rules, decides who joins, and keeps track of entry fees. Organizers can add co-organizers to help them. An organizer is responsible for running their pool fairly, for collecting and paying out any money, and for settling disagreements between members.
4. Results and sports data
Scores and schedules come from third-party sports data sources. We work to keep results accurate and correct them when the source changes, but delays, errors and postponements can happen. The standings in Buddy Pools are a record to help your group, not a guarantee. Buddy Pools is not affiliated with, or endorsed by, any league or team, and team names belong to their owners.
5. Fees
- Pools with up to 10 entries are free.
- Larger pools may need a one-time payment per pool, per season, based on the pool's size. The price is shown before you pay, in US dollars, with any sales tax included. Only the organizer or a co-organizer who chooses to buy a size pays; players never pay Buddy Pools.
- Payments are taken by our payment provider. If a pool is deleted before its first pick locks, the payment is refunded in full. After the first pick locks, payments are final.
- We are not charging for any pool yet. We will announce it on this site before charging begins.
6. Using the service fairly
Don't:
- use the service for anything unlawful, or to harass, threaten or deceive anyone;
- use offensive or misleading names for pools, entries or nicknames, or post such messages;
- pretend to be someone else, or share or sell your account;
- try to get into accounts or data that aren't yours, overload or attack the service, or copy it with automated tools;
- copy, modify or reverse engineer the service, except where the law allows it.
7. Your content
Pool names, messages, nicknames and other things you add stay yours. You let us store and show them to the members of your pools so we can run the service. We may remove content that breaks these terms.
8. Closing an account or a pool
You can stop using the service at any time and ask us to close your account at support@buddypools.com. We may suspend or close an account, or remove a pool, that breaks these terms. Where we reasonably can, we will tell you why first.
9. Changes
We may change the service and these terms. If a change matters, we will tell you by email or on the site before it takes effect. Using the service after a change means you accept it.
10. No warranty
The service is provided "as is" and "as available". As far as the law allows, we don't promise it will always be available, free of errors, or right for your purpose.
11. Limit on our liability
As far as the law allows, Buddy Pools is not liable for indirect or consequential losses, or for any loss of money arranged between members of a pool, including entry fees and prizes. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Nothing in these terms limits rights you have under consumer protection laws that can't be limited.
12. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be heard in the courts of Ontario, unless the law where you live gives you the right to bring it there.
